Subsuming follows an affirmance by the Board. It should be applied to the same determination and issue, not assumed for every subject mentioned anywhere in the agency or Board documents.

Subsuming means the affirmed agency determination no longer stands as a separate final decision for the issue the Board decided. The final Board decision becomes the operative appellate decision. This distinction can matter when identifying the decision and issue involved in a later finality or clear-and-unmistakable-error question.
What to check in your records
Match the issue decided by the agency with the precise issue the Board affirmed, including the benefit, theory, period, and disposition.
- Keep the agency decision, its notice letter, and the evidence list used at that level.
- Preserve the complete Board decision and its stamped mailing date.
- Create an issue-by-issue comparison showing which agency determinations the Board affirmed and which it did not reach.
Identify the final decision at the issue level
Read the Board's order and reasons together. Record exactly what was affirmed because the rule links subsuming to that determination, not automatically to every earlier action in the file.
When reviewing finality or possible error, cite the decision that actually controls the issue and keep both the agency and Board records available. Choosing a review procedure is a separate legal question.
Does every earlier VA decision disappear after a Board decision?
No. This section addresses an agency determination that the Board affirmed. The issues and dispositions must be matched before deciding that an earlier determination was subsumed.

§ 20.1104 Rule 1104. Finality of determinations of the agency of original jurisdiction affirmed on appeal.
When a determination of the agency of original jurisdiction is affirmed by the Board of Veterans' Appeals, such determination is subsumed by the final appellate decision.
