What this means
Age cannot be used as a factor in evaluating service-connected disability. In a service-connected total-rating claim, inability to work due to advancing age or an unrelated disability cannot supply the basis for the rating.
Compensation and pension follow different rules. This section says age may matter for pension, which is why an explanation from a pension case should not be transferred directly to a TDIU claim.

It helps you focus the records on what service-connected conditions prevent you from doing. Being older does not by itself establish or defeat the service-connected disability question.
What to check in your records
Use your decision, examination reports, and relevant records to check the following points.
- Confirm whether the decision addresses compensation or pension.
- Find the medical descriptions of limitations caused by service-connected conditions.
- Check whether the decision's reasoning relies on age instead of the relevant disability evidence.
Separate age from the effects of the disability
Retirement can coincide with worsening health, but the two are different facts. For a service-connected evaluation, describe the functional effects attributable to the recognized disabilities rather than using age itself as evidence of severity.
The same distinction matters when reading a work-related opinion. An explanation that someone is unlikely to be hired because of age does not answer the same question as an explanation of limitations caused by service-connected disability. Keep pension discussions separate because that benefit follows different rules.
Does being past retirement age prevent a service-connected total rating?
Age is not to be used as a factor in the service-connected rating analysis described here. The relevant disability requirements still must be met. Neither older age nor younger age should be substituted for evidence about the actual effects of service-connected conditions.

§ 4.19 Age in service-connected claims.
Age may not be considered as a factor in evaluating service-connected disability; and unemployability, in service-connected claims, associated with advancing age or intercurrent disability, may not be used as a basis for a total disability rating. Age, as such, is a factor only in evaluations of disability not resulting from service, i.e., for the purposes of pension.
