Active Duty, Guard, and Reserve service dates and duty status
Guard and Reserve histories can include legally different periods. Record each period from orders, pay, personnel, treatment, and unit records, and keep an uncertain duty status unverified until a reliable source resolves it.
Overview
A Guard or Reserve career can contain active duty, active duty for training, inactive duty training, full-time National Guard duty, mobilizations, annual training, drills, travel, and civilian employment. The evidence and legal questions are not identical for every period. Membership does not identify the duty status Do not assume that Guard or Reserve membership, a retirement-points total, a uniformed workday, or a drill alone proves the duty status required for a particular claim. Build the period from source records and mark unresolved status as unverified.

Keep the broad duty categories distinct
High-level orientation only; 38 CFR 3.6 and the claim-specific facts control. Period Evidence question to organize Active duty Current disability, an event, injury, or disease during active duty, and relationship evidence, subject to applicable rules and presumptions. Active duty for training Current condition, disease or injury incurred or aggravated during the training, and relationship evidence. Inactive duty training Current condition tied to an injury or aggravation of an injury during training, or another event expressly covered by current law, with relationship evidence. Civilian technician or other employment Employment facts and records remain separate from any military orders or duty-status analysis. Do not reduce the rule to a slogan Avoid statements such as “anything during drill counts” or “illnesses never count.” Confirm the actual period, event, current rule, and evidence. Sources that may help verify a period
Orders and amendments. DD214s for periods that produced one. NGB Form 22 or 23 and retirement-points statements. Leave and earnings statements or military pay history. Unit calendars, rosters, attendance records, and line-of-duty files. Service, military, emergency, and civilian treatment records near the event. Incident, safety, accident, command, travel, and personnel records. Firsthand statements from leaders or service members. No single source is guaranteed to answer every question. A points statement can help locate a period without identifying the exact duty on a day. A treatment record can show care without proving orders. Orders can prove a period without proving the claimed event.
Build an event-to-duty packet
Date and location Use exact information when known and label an approximate range honestly. Unit and component Record the organization at the time of the event. Duty source Link orders, pay, roster, travel, or another source without overstating what it proves. Event source Link the treatment note, incident report, personal statement, or firsthand witness. Current-condition source Keep current medical and competent lay evidence distinct from the duty source. Relationship source Identify evidence addressing the connection when required without creating a medical conclusion.
When orders are missing or sources conflict
Identify the unit, higher headquarters, date range, and location. Preserve pay, points, attendance, travel, treatment, and personnel records. Request records through the appropriate custodian. Look for order amendments, vouchers, schedules, or line-of-duty files. Ask witnesses for firsthand facts, not a legal conclusion. Preserve both dates when records conflict and seek the underlying source. Never recreate an order Do not alter a points statement, rebuild a missing order, or change an original date. Explain which sources were searched and what remains unavailable.
Distinguish military duty from civilian employment
Some Guard members also work as federal or state technicians or in another civilian role. Wearing a uniform, working at an armory, or being employed by a military organization does not automatically establish the VA duty status for the event. Record whether the person was working under civilian employment or military orders. Identify the employer and time-and-attendance record. Link the military order or roster if one exists. Preserve any relevant workers' compensation or incident record. Mark classification as unverified when the sources remain unclear.
Review application service periods
Use the current VA Form 21-526EZ or online application and read its service-information instructions. Compare branch, component, entry and separation dates, unit, membership status, relevant training dates, and separation documents. Do not combine separate periods merely to shorten the form. Presumptions are a separate check A presumption may depend on qualifying service, location, dates, exposure, and other current requirements. Guard or Reserve membership alone does not establish every presumption, and the absence of one record type does not resolve every other service route.
Common mistakes to avoid
Listing only years of Guard or Reserve membership. Assuming every drill, school, activation, or technician day has the same status. Treating points as complete event proof. Treating a medical record as proof of orders. Omitting unit, location, or order amendments. Guessing ACDUTRA or INACDUTRA status. Asking a witness for a legal duty-status conclusion. Treating Pathfinder's broad profile entry as an official determination.
If service status is incomplete or disputed
If service status is incomplete or disputed I have a points statement but no order. Identify the exact date and unit. Check pay, roster, travel, personnel, and treatment sources. Request the underlying order and amendments from the appropriate custodian. Use the points statement as a locator, not final proof of the legal status for the event. Two records show different dates. Preserve both originals. Check amendments and the record-creation date. Identify the source closest to the official order or attendance record. Keep both dates visible and mark the period unverified until a reliable source resolves it. The event happened during civilian technician work. Identify the employer and time record. Check whether separate military orders covered the date. Do not infer status from uniform or location.
