Private treatment records and VA Forms 21-4142 and 21-4142a
You can generally submit private records you already have or use VA's current authorization and provider-information forms so VA can request identified records. Confirm current instructions and verify that evidence reaches the intended VA claim or review lane.
Overview
Private treatment records are non-federal records held by a private clinician, hospital, therapist, urgent-care center, rehabilitation provider, or other non-VA source. You can generally submit records you already have or authorize VA to request identified records. The best route depends on what you have, the records needed, the claim or review lane, and the current VA instructions. Pathfinder is not a release authorization Adding a provider, file, or task to Pathfinder does not authorize Claim Raven or VA to obtain records. It also does not prove that evidence reached VA, was associated with the correct matter, or is sufficient.
Choose between two evidence routes
Verify the current VA route before using either option. Authorize VA to request records An identified private provider holds relevant records you do not have and the current process permits VA development. Use current Forms 21-4142 and 21-4142a as instructed, identify the provider and treatment accurately, and follow up. The active VA lane matters A pending initial claim and a decision review or appeal can have different evidence rules and submission routes. Confirm the current lane before sending records or releases. A Higher-Level Review does not accept new evidence.
What the two forms do
Use the current VA form pages and instructions; do not rely on the title alone. Form Primary role Key review VA Form 21-4142 Authorizes disclosure of identified information to VA. Read the scope, expiration, sensitive-record provisions, certifications, and signature requirements before signing. VA Form 21-4142a Identifies the provider or facility and treatment information VA needs for the request. Check provider identity, address, treatment dates, condition or treatment description, and all required entries. VA commonly directs veterans to submit the forms together when asking VA to obtain private treatment records. Always follow the instructions on the current form pages and the notice for the active claim or review. Form 21-4142 carries its own warning: do not complete it unless you want VA to obtain private treatment records for you. If you already provided the records or will get them yourself, the form says there is no need to fill it out and doing so will lengthen claim processing. It is also not needed for VA medical records. The form repeats the rule in 38 CFR 3.159(c) that VA will not pay any fee a records custodian charges.
Route A: submit records you already have
Confirm relevance and scope Identify which claim question, condition, provider, and date range the records address. Do not send unrelated records merely because they are medical. Review every page Check patient identity, provider, dates, completeness, legibility, and whether another person's records were included by mistake. Preserve the original Keep an unchanged source copy and make a separate working copy for organization or redaction decisions. Use the correct current VA route Confirm that the active claim or review lane accepts new evidence and use the official submission method for that lane. Keep receipt evidence Save available confirmation and later verify that the intended VA matter shows the evidence when the official system supports that check.
Route B: authorize VA to request records
Open both current form pages Confirm the revision date and read the instructions for VA Forms 21-4142 and 21-4142a before filling them out. Identify each provider accurately Use the provider or facility's current name, address, relevant treatment dates, and treatment information. Separate providers when the instructions require it. Review the authorization Understand what may be disclosed, to whom, for what purpose, and when the authorization expires or may be revoked. Do not sign a blank or materially incomplete release. Follow the current submission instructions Send the forms through the official route for the active matter and preserve a signed copy and available confirmation. Track reasonable follow-up VA may make reasonable efforts to obtain identified non-federal records, but provider response, fees, timing, and completeness are not guaranteed. You remain responsible for ensuring non-federal records reach VA VA's standard-claim guidance says VA will make reasonable efforts to obtain private records you identify, but you must make sure VA receives the non-federal records. VA also states that it does not pay fees charged by a private provider for records.
Fill out VA Form 21-4142 section by section
The current Form 21-4142 is dated August 2024. It is the consent that lets a source release records to VA. It does not name specific providers; that is the job of Form 21-4142a. Form 21-4142, August 2024 edition, in form order. Section Items What it asks What to check I: Veteran identification 1 to 8 Name, Social Security number, VA file number, date of birth, service number if any, mailing address, phone, and optional email with a box to agree to electronic correspondence. Match the identifiers on your claim so the release is associated with the right file. II: Patient identification 9 to 11 Name, Social Security number and VA file number of the patient, only if the records are about someone other than the veteran. Leave blank when the records are your own. III: Source of records No items The kinds of sources the consent covers: all medical sources, including mental health, correctional, addiction treatment and VA health care facilities; social workers and rehabilitation counselors; consulting examiners used by VA; employers, insurers and workers' compensation programs; and others who may know about your condition. Name the actual providers on Form 21-4142a. IV: Records to be released No items All medical records, including information about daily living; specific permission for sensitive categories such as mental health records (not psychotherapy notes), substance use, sickle cell anemia, records that may show a communicable or non-communicable disease including HIV/AIDS tests, and genetic test results; how your condition affects daily tasks and work; and information created within 12 months after you sign, as well as past information. Read the whole list before signing. The scope is broad unless you limit it in Item 12. V: Authorization and signature 12 to 16 Item 12 is where you write any limitation. The section states the recipient (VA), the purpose, and that the authorization is good for 12 months from the date in Item 14. Item 13 is your signature, 14 the date, 15 your printed name, and 16 your relationship if you sign for someone else. Sign and date only after the provider information on Form 21-4142a is complete. Item 12 is the only place to limit what is released If you want to limit the consent, for example to one condition or one date range, write the limitation in Item 12. The form says that if Item 12 is left blank, there is no limitation to records. A limit that is too narrow can leave out records VA needs, so match it to the treatment that matters for your claim. The authorization expires after 12 months The form says the authorization is good for 12 months from the date you sign and date it in Item 14, and that it expires automatically after 12 months unless you revoke it sooner. To revoke, the form says to send a written statement to the VA office handling your claim, or the Board of Veterans' Appeals if the claim is on appeal, and a copy to each source. Keep the signing date in your records.
Fill out VA Form 21-4142a for each provider
The current Form 21-4142a, also dated August 2024, identifies where VA should ask. Sections I and II repeat the veteran and patient identification. Section III has room for five providers in Items 9 to 13. For each one, A is the provider or facility name, B is the condition you were treated for, C is the treatment period with From and To dates, and D is the provider's street address. The form's Privacy Act notice warns that if the information is incomplete or inaccurate, the provider may not be able to identify and locate your records. Synthetic practice entry for Items 9A to 9D. The clinic and dates are invented. 21-4142a field Practice entry Real-world check 9A: Provider or facility name Example Orthopedic Clinic Is this the current records custodian, or only the name of a physician who has moved or retired? 9B: Conditions treated Right shoulder Match the treatment in the records without adding a diagnosis the records do not contain. 9C: Dates of treatment From 03/01/2022 to 11/30/2022, approximate Check appointment summaries or billing statements and note any uncertainty. 9D: Street address The facility's verified records address Confirm the records address with the provider's records office before submitting. If a practice closed, merged or a doctor retired, find out who holds the records now before you list an address. The custodian may be a successor practice, a hospital system, or a records storage company. Listing a closed office usually means VA's request goes nowhere.
How VA follows up on private records
Under 38 CFR 3.159(c)(1), VA's reasonable efforts to get records from a private provider generally consist of an initial request and, if the records do not arrive, at least one follow-up request. A follow-up is not required if the first response says the records do not exist or that asking again would be futile. The same rule says you must give enough information to identify and locate the records, including the custodian, the approximate time frame, and the condition treated, and authorize the release if needed. If VA cannot get the records after those efforts, 38 CFR 3.159(e) requires VA to tell you, and for private records VA may send that notice with its final request. At that point you can request the records yourself and submit them. Because VA's required efforts can end after two requests, asking the provider for a copy yourself and submitting it through the correct VA route is another way to get the records in front of VA.

Handle specially protected records carefully
Some sensitive records may have additional authorization or provider requirements. Read the current form language and provider instructions rather than assuming a general release covers every record. Request only what is relevant and do not expose more information than the authorized purpose requires. Never upload or email a blank signed release A signed authorization can permit disclosure of highly sensitive health information. Complete and review all required provider, date, scope, and recipient information before signing, then protect the signed copy.
Use Pathfinder as an organizer, not proof of submission
Pathfinder labels describe your saved work, not a VA adjudicative conclusion. Pathfinder action What it means What it does not mean Add a private-record task You saved an item to work on for a condition. The records exist, are relevant, or are legally sufficient. Upload or link a working copy You organized a source inside the available product workflow. VA received the source or Claim Raven can disclose it for you. Mark a task complete You recorded that your selected task is complete. The provider responded, VA associated the evidence, or every page arrived. Save failed Pathfinder did not confirm the update. The task or milestone was persisted. Retry before relying on it.
Verify receipt and scope
Keep a copy of the exact records or forms submitted. Keep official confirmation when the submission route provides it. Check the intended claim or review lane rather than assuming evidence moved between matters. Read any VA follow-up request and respond according to its stated date and instructions. If a provider sends only part of a chart, record what is missing without guessing why. Do not treat a Pathfinder task label as proof of VA receipt.
Common mistakes to avoid
Using an old form without checking the current VA revision and instructions. Signing a blank or materially incomplete authorization. Listing an old provider address without verification. Assuming VA pays a provider's records fee. Assuming VA will obtain every requested page on the first attempt. Submitting new evidence into a lane that does not accept it. Treating a Pathfinder upload, link, or completed task as VA receipt. Emailing sensitive medical records or signed releases to ordinary support.
If private records are delayed, missing, or sent to the wrong place
If private records are delayed, missing, or sent to the wrong place I already have the records. Confirm the active VA lane accepts evidence. Review identity, dates, scope, and legibility. Use the current official submission route and keep confirmation. Submit the reviewed records directly when appropriate instead of authorizing VA to request the same pages unnecessarily. The provider has not responded. Confirm the provider name, address, and relevant dates. Review any VA development notice and the efforts described. Ask the provider about its process and any fee without promising VA payment. Continue reasonable follow-up and make sure VA receives the non-federal records; do not assume the authorization guaranteed production. The records contain highly sensitive information. Read the current authorization language. Identify the specific relevant records and purpose. Use a secure official channel appropriate to the recipient. Do not send the records or a signed release to ordinary support. Follow the current form and provider requirements for specially protected information. I added the records to Pathfinder but cannot see them in VA status. Confirm what was saved inside Pathfinder. Check whether you separately used the correct VA route. Use available official confirmation or claim-status evidence views for the intended lane. A Pathfinder task or file organization step is not a VA submission. Use the official route and preserve its receipt evidence. Return to Records Check-In or Evidence Builder to organize the provider, source, and next task.
